Terms governing framing and construction services provided by Garcia Framing Inc.
Garcia Framing Inc. ("we," "us," or "our") provides residential and commercial framing and construction services, including wood framing, structural framing, wall and roof framing, additions, remodeling support, rough carpentry, and related work for new construction and renovation projects. These Terms of Service govern the relationship between Garcia Framing Inc. and any customer or client ("you") who requests or receives our services.
Quotes and estimates provided by Garcia Framing Inc. are based on the information, plans, and site conditions available at the time the estimate is prepared. Estimates are not guaranteed final prices and may be adjusted if actual site conditions, scope, or plans differ from what was originally reviewed. Formal pricing is confirmed in a project agreement or invoice prior to work beginning.
Work begins only after the scope of work, pricing, and timeline have been agreed upon, whether through a signed proposal, written agreement, or accepted estimate. Any project agreement entered into with Garcia Framing Inc. supplements these Terms of Service, and where a conflict exists, the specific project agreement will govern.
Payment for services is due according to the terms specified on the applicable invoice. Garcia Framing Inc. may require deposits or milestone payments at agreed stages of a project prior to continuing work. Failure to make payments as invoiced may result in a pause of work until payment is received.
Any changes to the agreed scope of work, including additional framing, design changes, or client-requested revisions, may result in adjusted pricing and timeline. Scope changes will be communicated and agreed upon before additional work is performed where reasonably possible.
Framing and construction work may uncover structural issues, concealed damage, or site conditions that were not visible or known at the time an estimate was prepared. Garcia Framing Inc. is not responsible for pre-existing structural conditions, and any additional work required to address such conditions will be communicated to the client and may result in additional charges.
Unless otherwise agreed in writing, material selection, ordering, and sourcing are coordinated as part of the project scope. Material costs are subject to market pricing at the time of purchase and may affect the final project cost if not locked in at the time of the estimate.
Project timelines are estimates and may be affected by factors outside our control, including weather, material availability, permitting, inspections, other trades, and site access. Garcia Framing Inc. will communicate known scheduling changes but is not liable for delays caused by such factors.
Either party may cancel a project prior to the start of work by providing written notice. Cancellation after work has begun may require payment for services performed and materials ordered or purchased up to the point of cancellation.
To the fullest extent permitted by law, Garcia Framing Inc.'s liability for any claim arising from our services is limited to the amount paid for the specific services giving rise to the claim. Garcia Framing Inc. is not liable for indirect, incidental, or consequential damages arising from framing or construction services.
These Terms of Service are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these terms will be resolved in a court of competent jurisdiction within the State of California.
